These Terms of Use ("Terms") govern your access to and use of the Americano Health mobile application, website, and related services (collectively, the "Service") operated by Americano Health, LLC ("Americano Health," "we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you meet this requirement. Parents and legal guardians may create and manage health profiles for minors under their care.
2. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You must notify us immediately of any unauthorized use of your account.
3. Description of Service
Americano Health provides tools to organize, store, and manage personal health information including medical records, medications, appointments, symptoms, and related data. The Service also offers AI-powered insights and summaries to help you better understand your health information.
4. Medical Disclaimer
The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. Content generated by the Service, including AI-powered insights, summaries, and correlations, is for informational and organizational purposes only.
You should not rely on the Service as a substitute for professional medical advice. Always consult a qualified healthcare provider with questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided through the Service.
5. Subscriptions and Billing
- Certain features of the Service require a paid subscription. Subscription plans and pricing are available on our Pricing page.
- Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select.
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
- We reserve the right to change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
6. Caregiver Access
The Service allows account holders to invite caretakers to view or manage health profiles. By inviting a caretaker, you grant them access to the health data within the shared profile(s). You are responsible for managing caretaker permissions and may revoke access at any time. Americano Health is not responsible for actions taken by caretakers you have authorized.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Upload false, misleading, or fraudulent health information for another person without authorization.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to develop a competing product or service.
- Scrape, harvest, or collect data from the Service through automated means.
8. Intellectual Property
The Service and its original content (excluding user-provided data), features, and functionality are owned by Americano Health, LLC and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of all health data and personal information you provide to the Service.
9. User Content License
By submitting content to the Service, you grant Americano Health a limited, non-exclusive, worldwide license to use, store, process, and display that content solely for the purpose of providing and improving the Service. This license terminates when you delete the content or your account.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
12. Limitation of Liability
To the maximum extent permitted by law, Americano Health, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Americano Health, LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) will survive.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles.
16. Dispute Resolution
Any dispute arising from these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association. You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Americano Health, LLC regarding the Service and supersede all prior agreements and understandings.
